DAQRI SMART DEVICES, INCLUDING THE DAQRI SMART GLASSES AND DAQRI SMART HELMET ("DAQRI Devices"), ARE NOT INTENDED FOR THE GENERAL CONSUMER, AND INSTEAD, ARE MADE AVAILABLE SOLELY FOR ENTERPRISE USE AND THE DEVELOPER COMMUNITY ONLY. IF YOUR ORGANIZATION IS ADMINISTERING YOUR USE OF THE DAQRI DEVICES, PLEASE DIRECT YOUR PRIVACY INQUIRIES TO YOUR ADMINISTRATOR.

IMPORTANTLY, DAQRI DEVICES ARE CURRENTLY DESIGNED TO CONNECT TO AN INTRANET PROTECTED BY FIREWALL AND OTHER SECURITY MEASURES THAT ARE PUT IN PLACE BY THE RESPECTIVE ENTERPRISE. FOR EASE OF DEVELOPMENT AND MAINTENANCE, DAQRI DEVICES ARE CONFIGURED FOR FLEXIBLE NETWORK ACCESS AND DESIGNED TO OPERATE IN A SECURE OPERATING ENVIRONMENT WITH PROPER PHYSICAL AND NETWORK PROTECTIONS. INTRODUCTION

All references of "DAQRI," "us," and "we" in this policy, is meant to include DAQRI's subsidiaries and affiliates. As a general matter, DAQRI collects a variety of information ("Collected Information") to provide professional grade services and make Augmented Reality a standard tool for the workforce. As you can imagine, AR requires a large amount of data collection and processing in order to properly function.

Additionally, we collect information for marketing purposes. We believe that augmented reality can maximize the skill and efficiency of any work force in ways not yet realized. Thus, some information is collected to identify companies for targeted marketing.

DAQRI collects personal information from a number of sources in order to provide you with exceptional services related to augmented reality. These sources can be broken down into the following three categories:

1. WEBSITE:

DAQRI considers itself a Controller for all information collected through DAQRI.com. This section serves as a summary of the type of information that the website may collect, the legal basis for the collection, and the processing performed on such information.

Information You Provide Directly to Us Through our Website:

Processing Performed: When you visit our website, you may have the opportunity to provide personal information such as your name, contact information, and company name, etc., for the purpose of inclusion on our mailing list to receive additional information related to products and/or services offered by DAQRI. To the extent you voluntarily provide such information, DAQRI will use the information for the purposes described therein.

Performance of a Contract with you: When you purchase a product, we will collect information related to purchasing entity, associated contact information, number of devices purchased, and any upgraded features. This information is necessary for us to provide correlated services related to support, payment, returns, and warranty related issues.

2. DAQRI DEVICE INFORMATION

This section serves as a summary of the type of information that the device is capable of collecting, the legal basis for the collection, and the processing performed on such information.

Information You Provide Directly to Us Through a User's Manual Upload:

Info: User Uploaded Content Legal Basis: Consent Processing Performed: We will not automatically store or collect any sensitive content such as images captured by device camera. Authorized users of their respective devices maintain full control of the upload and removal of any such content on a DAQRI controlled server.

Information Collected Automatically by DAQRI through a DAQRI Device:

Processing Performed: For our augmented reality Smart Devices to properly function, we may be required to collect certain information pertaining to information including unique device identifiers, serial numbers, current software versions, MAC address, IP address, and settings. The collection of this information will be used in a variety of ways to ensure functionality and security.

Processing Performed: Data about the device's use (what APIs were called, how long call times take, crash log data, and other analytic data) are all necessary for DAQRI to continue to improve the way applications are integrated, launched, and closed. Such data is also necessary to identify issues related to device/application crashes or other failures.

3. DAQRI ACCOUNT PORTAL

DAQRI considers itself a Processor for all information associated with the enterprise's designated DAQRI Account Portals. All that DAQRI requires is prerequisite information relating to unique account names and an email address associated with such account. It is the responsibility of the company to identify (and if required obtain) the prerequisite legal basis from any employee that it associates with the DAQRI Account Portal account. We will ensure that all information is processed in accordance with the legal basis established by the enterprise.  

DATA SECURITY MEASURES EMPLOYED BY DAQRI

DAQRI cares about the integrity of your personal information. When processing any customer data-whether as a processor or controller-we follow the company's organizational policies designed to protect the privacy of individuals by limiting when the information is used and by whom. Furthermore, our product development process considers privacy and security throughout the development reasonable physical, and other technological methods to transmit your data securely, such as TLS/SSL protocol, AES and RSA data encryption. The data is stored using Amazon's S3 cloud service.

Nonetheless, DAQRI cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation; and where appropriate, notify those individuals whose information may have been compromised in accordance with applicable laws and regulations.

SHARING YOUR INFORMATION

We may make both personally identifiable and anonymous information available to third parties in these limited circumstances:

(1) with your express consent;
(2) when such third party is a processor and its external processing is necessary for services related to our product;
(3) when we have a good faith belief that it is required by law;
(4) to any successor or purchaser in a merger, acquisition, liquidation, dissolution or sale of assets.
Your consent will not be required for disclosure in the cases of (2)-(4) above.

DATA RETENTION

We will not keep your personal data for longer than is necessary for the purpose it was collected. This means that data will be destroyed or erased from our systems when it is no longer required.

We take appropriate steps to ensure that we process and retain information about you based on the following logic:

at least the duration for which the information is used to provide you with a service; 
as required under law, a contract, or with regard to our statutory obligations; or
only for as long as is necessary for the purpose for which it was collected, is processed, or longer if required under any contract, by applicable law, or for statistical purposes, subject to appropriate safeguards.  

ACCESSING AND CORRECTING YOUR INFORMATION

You have rights with respect to your personal information:

A right to request details about the information we have collected about you;
A right to correct any inaccuracies in we have collected about you.
A right to object to or restrict processing of your personal information;
Revoke any consent that has previously been granted to us (however, withdrawing such consent shall not affect the lawfulness of legal processing prior to your withdrawal or any other processing done in reliance on other legal basis grounds). 
You have the right to complain to a data protection authority about our collection and use of your personal information.  

If you ask us to shut down your account or delete your information, we will disable your account within a reasonable period of time.

Please note that we may need to retain some information about you in order to satisfy our legal and security obligations. For example, some of your information may remain in back-up storage even if you ask us to delete it. In some cases, you may be entitled under local laws to access or object to the processing of information that we hold relating to you. CHILDREN

Nothing we provide is intended for children under thirteen (13) years of age. We do not knowingly collect personal information from children under 13. If you are under 13, do not use our website, online portals, devices, or any respective features otherwise. If you are under 13 years old, do not provide to DAQRI any information about yourself including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at legal@daqri.com with the subject heading "Child PII Inquiry."

CHANGES TO OUR PRIVACY POLICY

We may update this Privacy Policy to reflect changes in our practices and service offerings. If we modify our Privacy Policy, we will update the "Last Modified Date" and such changes will be effective upon posting.
